The public organization “World of Law” has developed the “Guide on the Adjudication of Torture Cases in the Courts of Tajikistan” within the framework of the project “Path to Justice: Strengthening Human Rights through the Prevention of Torture and Reform of the Penitentiary System,” funded by the European Union.
The document aims to strengthen judicial practice in torture cases and provides an analysis of the legal and institutional framework, international and national standards for reparation to victims, issues related to the identification of torture in medical institutions, as well as key international instruments in this field.
The guide includes examples of court decisions and comparative international practice, an analysis of relevant international standards and case law, practical recommendations for their application in the judicial practice of Tajikistan, checklists and templates for judicial decisions, standard questions for assessing coerced confessions and procedural violations, as well as adapted samples of procedural documents and protocols for handling complaints of torture and ensuring the protection of victims in court proceedings.
